These Terms apply to your use of our website and to purchases made directly from us.

Our Delivery Policy, Returns & Refunds Policy and Privacy Policy should also be read alongside these Terms.

2. Our Products

FITAMIN® sells food supplements and related wellness products.

Products may be manufactured, stored, packed and/or dispatched on our behalf by specialist third-party manufacturers, suppliers, warehouses and fulfilment partners.

Use of third-party manufacturers or fulfilment partners does not remove any consumer rights that apply against us as the contracting seller.

3. Product Information

We take reasonable care to ensure that material product information displayed on our website is accurate.

Product packaging, artwork or other presentation may occasionally be updated.

Always read the current label, ingredient information, directions and warnings supplied with the physical product before use.

If a product you receive materially differs from what you ordered, or if any important safety information appears unclear, please contact us before using it.

We will not knowingly substitute a materially different product, formulation, strength or pack size without appropriate notice or consent where required.

4. Food Supplements & Health Information

6. Orders & Contract Formation

After an order is submitted, you will normally receive an automated order acknowledgement.

An order acknowledgement confirms that we have received your order but does not necessarily mean that your order has been accepted.

Unless we expressly tell you otherwise, our acceptance of your order occurs when we confirm that the relevant goods have been dispatched.

We may refuse or cancel an order before acceptance where reasonably necessary, including because of:

product unavailability;
an obvious pricing or listing error;
failed or unauthorised payment;
suspected fraud or misuse;
applicable regulatory restrictions;
carrier or destination restrictions;
suspected unauthorised commercial purchasing; or
inability to fulfil the order.

If payment has already been taken for an order that we subsequently cancel, we will refund the appropriate amount.

7. Prices & Payment

Product prices and applicable delivery charges will be displayed before you complete checkout.

Applicable taxes and other charges collected directly by FITAMIN® will be reflected through checkout where appropriate.

International orders may also be subject to the customs, duties and tax arrangements described in our Delivery Policy.

We reserve the right to correct obvious typographical, technical or pricing errors.

If an obvious pricing error is identified before your order has been accepted, we may cancel the affected order and refund any amount already paid rather than supply the product at a clearly unintended price.

8. Product Availability

Products and stock availability may change without notice.

Adding a product to your basket does not reserve that product.

If a product becomes unavailable after you place an order, we may:

contact you regarding an appropriate alternative where suitable;
remove the unavailable item and refund the relevant amount; or
cancel the affected order and refund the relevant amount.

We will not materially substitute a product without appropriate consent where required.

9. Promotions, Bundles & Discount Codes

Promotional offers may be subject to specific conditions displayed with the promotion.

Unless otherwise stated, promotions may:

be available for a limited period;
exclude particular products;
require a minimum purchase;
be limited to one use per customer or order;
be subject to product availability; and
not be combined with another promotion.

Promotional codes and free gifts have no cash value unless expressly stated otherwise.

Where part of a qualifying bundle, multi-buy or promotional order is returned, any applicable recalculation will be handled in accordance with our Returns & Refunds Policy.

10. Delivery

Our Delivery Policy forms part of these Terms.

Products may be fulfilled from different locations and a single order may therefore arrive in separate parcels.

Delivery times are estimates unless expressly stated to be guaranteed.

Please ensure that all delivery information supplied at checkout is accurate.

11. Returns, Refunds & Cancellations

Returns, cancellations and refunds are governed by our Returns & Refunds Policy and applicable consumer law.

Our Return Merchandise Authorisation (RMA) process is intended to help correctly identify and route returns.

Nothing in our return procedure is intended to remove or restrict mandatory statutory rights.

Products must be used and stored in accordance with the directions and warnings supplied with them.

To the extent permitted by law, we will not be responsible for loss caused solely by:

use contrary to clear product directions or warnings;
exceeding the stated recommended intake;
improper storage after delivery;
alteration or tampering after delivery;
combining products contrary to clear warnings; or
continued use after becoming aware that a product may be damaged or unsuitable.

Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited.

13. Product Safety, Withdrawals & Recalls

If we become aware of a genuine safety, quality or regulatory issue affecting a product, we may contact customers who purchased the affected product and provide appropriate instructions.

These instructions may include asking customers to:

stop using the product;
retain the product and packaging;
provide the batch or lot number;
return or dispose of the product as directed; or
provide other information reasonably necessary for a safety investigation.

Please follow any product withdrawal or recall instructions supplied by FITAMIN®.

Nothing in this section limits any rights or remedies available under applicable law.

14. Personal Use & Commercial Purchasing

We may limit quantities or refuse or cancel an order before acceptance where we reasonably believe that:

unusually large quantities are being purchased for unauthorised commercial distribution;
an order is connected with fraudulent activity;

Nothing in these Terms prevents any resale or other activity that cannot lawfully be restricted.

15. FITAMIN® Trade Mark & Intellectual Property

FITAMIN® is a registered trade mark used by Fitamin Supplements Inc. with the permission of the registered proprietor.

Unless otherwise stated, the website, FITAMIN® brand materials and original content appearing on it are owned by, licensed to or lawfully used by Fitamin Supplements Inc.

This may include:

the FITAMIN® name and logos;
brand identity and visual assets;
original packaging and label artwork;
original photography;
graphics;
website design elements;
written product and marketing content; and
other original materials.

Except where permitted by law or with appropriate permission, you must not copy, reproduce, republish, distribute or commercially exploit protected FITAMIN® content.

You must not use the FITAMIN® trade mark, confusingly similar branding or our brand assets in a manner that falsely suggests:

affiliation with FITAMIN®;
sponsorship or endorsement by FITAMIN®;
authorised distributorship;
authorised commercial representation; or
another commercial relationship that does not exist.

We reserve all intellectual-property rights and remedies available under applicable law.

Third-party trade marks, product names and other intellectual property displayed in connection with third-party products remain the property of their respective owners.

16. Website Use

You must not knowingly use our website:

for fraudulent or unlawful purposes;
to interfere with the operation or security of the website;
to attempt unauthorised access to our systems;
to transmit malicious software or code;
to impersonate another person;
to misuse customer accounts or promotional offers; or

Nothing in these Terms is intended to exclude or restrict legal requirements relating to goods being of satisfactory quality, fit for purpose or as described.

carrier or transportation disruption;

customs or border delays;
interruption to essential systems;
regulatory or government action; or

The remaining provisions will continue to apply.

To the extent permitted by law, these Terms and any contract between you and FITAMIN® are governed by the laws of England and Wales in relation to purchases made by consumers in the United Kingdom.

This choice of law does not deprive you of any mandatory consumer protections available under laws that would otherwise apply to you in your place of residence.

If you are a consumer resident in the United Kingdom, you may bring legal proceedings in the courts available to you under applicable law, including, where applicable, the courts of the part of the United Kingdom in which you live.

Nothing in these Terms limits rights relating to governing law or jurisdiction that cannot lawfully be restricted.
